Financial Consent Order Online – Save Thousands in Legal Fees
A financial consent order is a legal document used in divorce proceedings that makes a divorcing couple’s agreed financial settlement legally binding. It can cover the division of property, pensions, savings, debts, lump sum payments, and ongoing spousal maintenance between you and your ex-spouse. Once sealed by a Family Court judge, it becomes fully enforceable — giving both parties lasting certainty over their financial futures.
Without a consent order, there is no legal protection over your finances — even if you have a written agreement in place. Either party could make a financial claim against the other years later, even after remarriage.
You can apply for a consent order once your Conditional Order has been granted in the divorce process. You do not need to wait for your Final Order. A Family Court judge reviews the proposed order on paper, without either party needing to attend court.
If satisfied that the agreement is fair and reasonable to both parties, the judge seals it, at which point it becomes legally binding. Most consent orders are sealed within 4-10 weeks of submission, depending on the court’s workload.
If you and your ex-spouse have reached an agreement and want to make it official, a consent order is the only way to do so with full legal protection on both sides.
What can a consent order cover?
- Dividing the family home — whether one party is buying the other out, the property is being sold, or ownership is being transferred, a consent order makes that arrangement legally binding and protects both parties from future dispute.
- Protecting pension assets — pensions are often one of the most valuable assets in a marriage. A consent order can include a pension sharing arrangement, ensuring retirement savings are divided fairly and enforceably.
- Preventing future financial claims — without a consent order, your ex-spouse retains the legal right to make a financial claim against you years down the line. A clean break clause permanently severs all financial ties.
- Formalising lump sum payments — if one party has agreed to pay the other a lump sum, a consent order ensures that obligation is legally documented and enforceable, rather than relying on goodwill alone.
- Dividing savings and investments — bank accounts, ISAs, and investments accumulated during a marriage all form part of the matrimonial pot. A consent order sets out exactly how these are divided.
- Dealing with joint debts — divorce does not automatically separate joint financial liabilities. A consent order formally apportions responsibility for mortgages, loans, and credit agreements.
- Agreeing spousal maintenance — where one party is financially dependent on the other, a consent order formalises ongoing maintenance payments, including the amount and duration.

How Much Does An Online Consent Order Cost?
Most traditional divorce solicitors in England and Wales will charge between £1,500 and £5,000 to draft a straightforward financial consent order with uncomplicated finances. For couples with more complex cases and those with high-value assets, such as businesses, overseas assets, and property portfolios, divorce solicitors’ fees can exceed £10,000.
At Consent Orders Online, as part of our Self-File Consent Order Service, an experienced family law solicitor will prepare an individual consent order detailing the financial agreement you have reached with your ex-partner for a fixed fee of £269.
As part of this fee, we draft and prepare all the paperwork you need for a financial consent order agreement to be approved by the court following separation to help you move forward with confidence.
